GENERAL TERMS AND CONDITIONS

These general terms and conditions of sale apply to all purchases of products or services made on the Chainy website www.chainy.ch via the online shop (hereinafter the Site). The masculine form "customer" used hereafter naturally refers to both clients and customers. The specific conditions for the purchase of certain products or services are defined below.

The online offers of products and services are only valid as long as they are visible on the Site and within the limits of available stocks. The images appearing on the Site are for illustrative purposes only and do not form part of the contractual conditions. The information contained in the catalogues and explanatory notes is given for information purposes only and does not constitute a contractual document.

Chainy accepts no responsibility for any errors or omissions in the drawings, images or diagrams, or in the said catalogues or notices.


PRICES

The prices indicated on the Website are expressed in Swiss francs, euros and pounds sterling, depending on the recipient country. They are inclusive of all taxes (VAT) and include the advance recycling tax (ART). However, they do not include shipping costs, which will be invoiced separately. Chainy reserves the right to change its prices at any time, but the prices charged to the client for the products delivered are those in force on the date of the order and which appear on the order confirmation. In addition, promotional discounts offered in the context of commercial actions on the Website are deducted directly from the amount of the order.


CONCLUSION OF THE CONTRACT

The products and prices published in the online shop constitute an offer. However, this is always subject to the (resolutive) condition that delivery is possible or that the price indicated is free of error.

The contract is concluded as soon as the Client places an order with Chainy. The receipt of the order is confirmed to the client by an automatically generated e-mail sent to the address provided by the client. The automatically generated order confirmation e-mail does not constitute a guarantee of availability or delivery. It only indicates to the client that Chainy has received the order and that the contract has been concluded, provided that delivery is possible.


ORDER

An order only becomes final after it has been accepted by Chainy. The sending of the order by the client implies the acceptance of these general terms and conditions of sale in their entirety, to the exclusion of all other terms and conditions. Chainy reserves the right to refuse the order of a client.


PAYMENT

The price charged is the price indicated on the order confirmation sent to the client. Unless otherwise agreed, all products and services* are payable by: EuroCard/MasterCard, Visa, American Express, Paypal, ApplePay

All payment transactions are made in a secure area on the Stripe platform. The data recorded by Chainy & Stripe constitute the proof of all transactions carried out between Chainy and its clients. The data recorded by the payment system constitutes the proof of the financial transactions. The credit card used for payment is debited at the time of the order.

DELIVERY TIMES

The delivery times indicated on all order confirmations are indicative and apply from the moment the order confirmation is sent. Any request for cancellation of an order, and/or claim for compensation, for any type of delay in delivery on the part of Chainy is excluded.


EXCHANGES, RETURNS, WARRANTY CASES AND COMPLAINTS

The Client shall send complaints about defective goods and/or services and returns directly to Chainy by email (hello@chainy.ch) and shall settle the details of the procedure with Chainy. The existence of such disputes does not release the Client from his obligation to pay the invoice or the total value of the dispute. In the case of returns of goods purchased by "EuroCard/MasterCard, Visa, American Express, Paypal, Apple Pay", the refund or cancellation shall be made to the credit card or Paypal account indicated by the customer and made out in his name, provided that the customer has paid the original invoice in full.

It is the customer's responsibility to check the goods immediately upon delivery and to make any reservations and complaints regarding possible defects or non-conformities. In general, items returned incomplete, damaged or soiled by the customer will not be accepted. In the case of a return of goods, the shipping costs are to be paid by the customer.

DELIVERY


The goods are delivered without assembly or unpacking.
The delivery of your order is free of charge in Switzerland.

If the order consists of several items and the delivery times are different, Chainy will send the order in one go when it is complete.
If the order contains one or more bulky items, Chainy reserves the right to adjust the delivery costs. Chainy will then contact the Client to inform him/her of the delivery costs applicable to his/her order.

Upon request, it is also possible to customise the delivery of an order.

PRODUCT QUALITY

We strive to select suppliers offering good quality products. CHAINY declines all responsibility concerning the degradation of products due to natural elements (water, salt, sand, acidity of the skin, etc...) or to the contact of various cosmetic products (perfume, cream, make-up, etc...).

 

ORIGIN OF THE PRODUCTS :

Our suppliers are based in several countries in Asia and Europe.


RETURN CONDITIONS

In the event of dissatisfaction, it is possible to return and exchange the goods upon presentation of proof of payment. The goods must be returned in their original packaging, unused, clean, complete and undamaged. Items that have been damaged or soiled by the customer cannot be returned.

It is the customer's responsibility to check the goods immediately upon receipt and to report any defects or differences from the order. The statutory provisions on complaints (Art. 201 CO) apply.

Returns are possible within 7 calendar days of receipt. If the customer is unable to provide confirmation of receipt, the 7-day period is counted from the date of dispatch of the order.

Only items in their original, unused, clean, complete and undamaged packaging, together with the return form, will be returned. In the case of a return of goods, the shipping costs are to be paid by the customer, who also bears the shipping risk. The goods must be returned by post. For a return by post, the goods must be sent to the following address:

Refunds can only be made by the same means of payment as the original payment. Therefore, no cash refunds will be made. After receiving the goods, Chainy will check that they are in good condition and, if necessary, will decide on a refund. This refund is made by the same means of payment as the original payment, usually within 5 working days. Only the value of the goods is refunded. Any shipping costs will not be refunded.


EXCLUSION OF THE RIGHT OF RETURN

All articles covered with fabric/leather, made of wood species or ordered specially for the customer cannot be returned or exchanged. Furthermore, special finishes cannot be returned or exchanged.

GUARANTEE

In case of delivery of defective goods, the procedure is the same as for returns. The client must inform Chainy. The delivery note and the goods in their original packaging must be presented. The invoice with the product description serves as a warranty certificate. Exchange under warranty or repairs under warranty do not result in any extension of the original warranty period.


RESOLUTORY CLAUSE

Any total or partial non-fulfilment by the client of one of its obligations, as well as the non-observance of any payment due date, may lead, at Chainy's discretion, either to the immediate payment of the sums still due on any grounds whatsoever, and the suspension of all deliveries, or to the cancellation of the contracts in progress.


APPLICABLE LAW / DISPUTES

This contract is subject to Swiss law.
